There are also some questions about the constitutional power of the government to regulate gambling. The First Amendment, which protects free speech, has been a factor in these arguments. However, the Commerce Clause, which allows for the government to regulate trade between states, has been an issue.

In addition, the Travel Act, which prohibits the use of interstate facilities for unlawful activities, is also applicable. State officials are concerned that the Internet could be used to transport illegal gambling into their jurisdictions.
